Your Rights Under the IDEA

The Individuals with Disabilities Education Act (IDEA) ensures that parents have significant rights and roles in the education of their children with disabilities. These rights include the ability to be involved in meetings related to the identification, evaluation, and educational placement of their child. Parents can access their child's educational records, request independent educational evaluations, and give or withhold consent before the school conducts evaluations or places the child in a special education program. Additionally, IDEA provides parents with the right to participate in the development of their child's Individualized Education Program (IEP) and to seek mediation or due process if disagreements arise with the school regarding their child's education. These rights ensure that parents are active partners in shaping their child's educational experience.

Rights to Access SPED Services Through MCSD

Child Find

Child find is a component of the 2004 Individuals with Disabilities Education Act (IDEA) that requires states to locate, identify, and evaluate all children with disabilities, from birth to 21, located within its jurisdiction who are in need of early intervention or special education services. Child find is an ongoing cooperative effort that involves state and local education agencies (LEAs), parents, the community, professionals, related organizations, and private schools. IDEA requires all states to have a “comprehensive child find system” to assure that all children who are in need of early intervention or special education services are located, identified, and referred. In Arkansas, the lead agency for Part C of IDEA Early Intervention Program (children birth to 3 years) is the Arkansas Department of Human Services. The lead agency for Part B/619 (children ages 3-21 years), is the Department of Elementary and Secondary Education.

Child Find applies to all children including those who are attending private school, highly mobile, including migrant children, suspected of having a disability even though they are advancing from grade to grade, and homeless or a ward of the state.

Destruction of Records

Special education records are maintained in a locked location for 6 years after students graduate or leave the district. A notice is then posted and these records are destroyed in a confidential manner. Records are available to the student or parent (if the student is under 18) by request. Call the special education office at 501-332-5468, for records requests.
